Inheritance disputes may arise in various ways. Here are a few examples taken from actual cases:

1- The Executor had hired a real estate agent to offer for sale the decedent’s Del Mar, CA home for $850.000 to pay bills. Both heirs claimed the upscale home, having an unobstructed ocean view, should easily command $1,200,000 and objected to the sale going forward.

2 – The decedent had a huge blowout with his wife of 45-years when she had given his prized 1957 Chevy to her grown son from a former marriage. She argued that the car just sat in the garage under a cover and was of no use to anyone, since he was no longer legally able to drive. He didn’t force the issue and the car never returned to his garage, but he was apparently so furious, it was later determined, that immediately following the car give-away episode he had written a new will leaving her out. While he may have died feeling as if he was vindicated by his actions, the new Will the decedent created violates the law which guarantees a share of an estate to “a spouse” regardless of any Will. The wife went into probate court demanding her fair share of the estate.

3 – The widowed decedent had written a Will giving his sizable estate equally to his three adult children: two sons and a daughter. At the age of 83, having being denied a drivers license for some years, and needing to use a walker and tote an oxygen bottle everywhere, he really needed some part-time help. The adult children sought out and hired a 33-year old woman to drive “dad” to the community center to play cards and other errands. Dad then married the 33-year-old and had a new Will prepared that totally ignored his children and left the entire estate to the new wife. The three adult children learned of the new Will following his death and contested it on the grounds that new wife was a premeditated, calculating “gold-digger” and used undue influence over the decedent to disinherit them and enrich herself.
